Answer: After an application is filed, the assigned examining attorney will search the USPTO records to determine if a conflict exists between the mark in the application and another mark that is registered or pending in the USPTO.

If your mark incorporates a design or logo you must search for trademarks that might be confusingly similar. Use the index in the back of the Design Code Manual to locate the appropriate six-digit code.

Answer:
There are several ways to dispute use of your trademark by a third party. Depending on the factual situation, the Trademark Office may or may not be the proper forum. You should consider contacting an attorney.
